US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The case stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was held in immigration custody.
In her decision, the judge noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court challenge center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.
Conditions of Freedom
The judge, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision marks a significant turn in a complicated legal battle involving allegations of wrongful detention and contested gang associations.
