The ex-lawyer for the former president has left her position as the chief federal prosecutor in the state. This comes after a court battle that invalidated her legal standing to occupy the role.

Attorney General's Statement

The nation's top law enforcement official, Pam Bondi, confirmed the prosecutor's departure on the start of the week. Bondi stated that the court's "flawed" ruling made it "untenable" for her to effectively run her office.

"Do not interpret adherence to the ruling as defeat," she declared. "The effort will now stretch across the country."

Court Ruling

Habba's exit was triggered by a federal appellate panel found that she had been acting without proper authority as the top prosecutor. This ruling is expected to impact numerous legal proceedings in New Jersey.

The appellate judges ruled that a temporary posting that bypassed the advice and consent of the Senate ran afoul of the federal law governing appointments.

Ongoing Legal Battle

It was also stated that Habba will remain at the Department of Justice as a top consultant. They intend to challenge the decision of the court's action, with hopes of a different outcome.

On a social media platform, she contended that the court "cannot be permitted to second-guess the executive's selection of prosecutors tasked with performing the fundamental role of the presidency of criminal prosecution."

Performance in Office

The attorney general praised Habba's record and pointed out that under her leadership, the state capital of Newark saw a one-fifth decrease in criminal activity. She also stated that the Camden recorded its initial homicide-free summer since 1974 with no murders.

Connection to Donald Trump

Habba, first joined the former president's legal defense in 2021. She later defended her client in his hush-money trial in the previous year, leading to his guilty verdict on dozens of charges of falsifying business records.

Before her appointment to the role of US Attorney, Trump had stated he was naming her as his senior adviser during his second administration, calling Habba as a steadfast ally and a "tireless advocate for justice".
